TERMS & CONDITIONS FOR MYAPES PORTAL

1. Introduction
Welcome to MyAPES (https://www.myapes.me.uk), the official portal (the "Portal") for the Association of Protecting Exotic Species CIC ("APES", "we", "us", "our"). APES is a Community Interest Company registered in England and Wales (CIC No. 16253848).
These Terms & Conditions ("Terms") govern your access to and use of the Portal, including all content, tools, resources, and services provided through it.
2. Your Acceptance of These Terms
By accessing, browsing, or using the Portal, you (the "User", "you") confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use the Portal.
3. Other Applicable Policies and Terms
Your use of the Portal is also subject to our MyAPES Privacy Policy, which is available at:

The Privacy Policy details how we collect, use, and protect your personal data.
Furthermore, specific services offered through the Portal, such as creating a user account, submitting registration or contact update forms, and accessing the Stripe billing portal, are subject to additional terms and conditions. As of the date of these Terms, those specific service and account terms are also located at http://www.myapes.me.uk/privacy and are hereby incorporated by reference into these Terms.
4. User Accounts
Registration: To access certain features (e.g., billing portals, update forms), you may be required to register for an account. You must provide accurate, current, and complete information during the registration process.
Security: You are responsible for safeguarding the password and any other credentials used to access your account. You must notify us immediately at web.accounts@cu.apes.org.uk of any unauthorised use of your account.
Responsibility: You are solely responsible for all activities that occur under your account, whether or not you have authorised them.
5. Acceptable Use of the Portal
You agree to use the Portal only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Portal by any third party.
You must not:
Use the Portal in any way that is unlawful, fraudulent, or harmful.
Use the Portal to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material (spam).
Attempt to gain unauthorised access to the Portal, the server on which it is stored, or any server, computer, or database connected to it.
Introduce any viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
Use any automated system, script, or "bot" to access, monitor, or scrape content from the Portal, except where explicitly permitted by us.
Reproduce, duplicate, copy, or re-sell any part of the Portal in contravention of these Terms.

The Portal provides access to third-party portals and services, including but not limited to the Stripe billing portal.
Your use of such third-party services is subject to the terms and conditions and privacy policies of that third party (e.g., Stripe, Inc.). APES has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
7. Intellectual Property
All intellectual property rights in the Portal and its content (including text, graphics, logos, tools, and software) are owned by APES or our licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use the Portal for its intended purposes only. You must not copy, modify, distribute, or create derivative works from any content on the Portal without our prior written consent.
8. Disclaimers and Limitation of Liability
"As Is" Basis: The Portal is provided on an "as is" and "as available" basis without any warranties, express or implied.
No Guarantee: We do not guarantee that the Portal will be secure, error-free, or uninterrupted.
Limitation of Liability: To the fullest extent permitted by law, APES (including its officers, directors, employees, and agents) will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of (or inability to use) the Portal.
9. Suspension and Termination
We reserve the right to suspend or terminate your access to the Portal at our sole discretion, without notice, for any breach of these Terms.

Amendments: We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on the Portal. Your continued use of the Portal after such changes constitutes your acceptance of the new Terms.
Governing Law: These Terms, their subject matter, and their formation are governed by the laws of England and Wales.
Jurisdiction: You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising from or related to these Terms or your use of the Portal.
Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.
